I am new to the site and loving it. I wish I had known about this site when my son was first born. I'm interested in hearing from anyone who has attempted to sue the doctor. Canadian law seems much different than American. I'm in the process of finding a lawyer. Initially, we weren't going to sue but now that we are finding out that he might have some real difficulties as he goes through life, we may need some financial assistance. We are in Ottawa. We would love to hear from other parents - we are trying to educate outselves to better help our son. Thank you,

We are from Ottawa. We have a 5 year old daughter with a birth related BPI. We looked into suing but the lawyers we spoke to advised us that it would be difficult to win. You are right. The Canadian system is very diffrent than the American one.

Hi Wendy, I thought I would reply to your question from my post here. Ashley is 6 years old and has a moderate injury. She is unable to lift her arm above her shoulder and has a elbow contracture. Also she has about 80 - 85 % use of her hand/wrist. Finding Doctors where I live is not possible, there are not peidiatricions in our town so I asked our family Doc to send us to BC Childrens Hospital in Vancouver. Tanya, of tanyas bpi support group fame is from CA- and coincidently our group is conversing about litigation- we have some who have chosen agin and some who are in the process of - several live in CAnada -two who are suing- whaT is it you want to know>?

I came accross your query researching my daughter's circumstance.She underwent a surgery to fix a hole in her heart.Simple procedure in July 1999.She had a stroke and suffered a brain injury.I see I am responding to a concern from Feb 2001.My most sincere advise is never not consider legal action.If anything based on principle.I am currently representing my daughter in a major law suit.I will never back down until the End.That's the least I can do for her.
