$2M OBPI VERDICT
Well, after 7 years of waiting our daughter Lauren finally won her case. The jury came back with a guilty verdict and awarded her $2 million dollars. Lauren was 11 lbs 2 oz and was stuck during delivery. Her Dr. did not perform the standard of care by using all the techniques used to deliver a baby with shoulder distocia. Our lawyers practice anywhere in Illinois but, will help anyone get in contact with a good trial lawyer in your area. We were in court for over a week and heard from several plaintiff and defense experts. Our lawyers have won this type of case many many times due to the fact of being prepared. Every time the defense came up with something against them they were able to counter it with facts. I'm writing this to try and help any child that suffers from an OBPI. This injury CAN be PREVENTED. Our daughter Lauren will never have complete use of her arm and faces many surgeries and challenges in her life. Lauren is a very happy child and never let's what she can't do, get her down. All the money in the world will never replace what she doesn't have, but I hope it helps in later life. Lauren had surgery a TCH when she was 18 months old and is due for a visit soon. wow Congrats I hope we have hired such a good lawyer. He has also won many cases so we will see again congrats and best wishes to lauren

If you are not sure about your attorney, how do you go about getting a new one? Are there monetary penalties involved if they have already started researching? We did sign a contact, and they have another shoulder distocia case, but I am wondering if we have made the right decision... I know it is normal to have doubts, but I want to know my rights in case we do need to make a change.

Sorry to see that your child was so severely injured that you were forced to take this route. That said--ALRIGHT!!!! Hopefully she will be able to concentrate on her life and not be worrying about being so tired from overwork to pay the Dr. bills that she doesn't have time for therapy and that whole nasty circle. In addition you have educated twelve jurors, at least one judge, many clerks, security offices and however many others that popped in and out of that courtroom in the course of a week. And don't think they won't go home and talk about it so how many more will be educated? And then the next kid that comes in behind her...well you can see I am one excited happy camper. Awesome work!

I'm so happy for your family. As a parent I know there is no amount of money that can give her what she has lost but at least now she will get everything she needs for a bright future. You were very brave to go public with this and now it is public record. That being the case maybe it will stop one doctor from injuring another baby. Your daughter can be proud of that for the rest of her life.

We live in Illinois and this case was tried in Chicago, I'm not sure if our state has a cap. Our lawyers asked for $5.9m. Medical malpractice is a hard case I'm told. Our firm told us that you have to try and prove that the standard of care was not given. In Laurens case our Dr. had taken some bad notes after delivery. He only stated trying to do 2 maneuvers on my wife (mcroberts & super pubic pressure). After about 3 minutes of maneuvers, the nurse called for an emergency. Other doctors entered the room and ended up delivering Lauren with a postiure arm maneuver (opposite arm of the shoulder distoia). They also were trying to prove that the fetal weight estimate was wrong and this baby was macrosomic (over 4500 grams). Lauren was 5050 grams.
