We are currently involved in the mediation portion of our battle. My question is did anyone turn down a settlement and decide to go to trial? I feel so weird about everything that happened. I am now a little scared anyone been through this and want to tell me it will be allright?

Our case went to mediation. We accepted, the Dr/Hospital turned it down. Since they turned it down we went to trial. We had a jury trial and won. The amount was pretty similar to the mediation amount.

Our mediation was a sick joke. They didn't even offer anything near what we eventually settled for 1 week from trail. It also depends on where you live and how much jury's generally give in your area. I wished we lived in the next city because it was much better there, bigger city I guess.

We outright laughed at the offer during mediation, and the mediation attorney was horrible!!
We settled a few weeks later for a much higher dollar amount, that was about three days before our trial was to start.

The reason I ask is because we turned down the offering from them, I hope things work out.

We turned down what was offered to us at mediation. We weren't about to take what they offered and were more than willing to go to trial if we had to. Later they ended up scheduling a second mediation meeting, and somehow we were discussing much different numbers the second time around.
I have a friend who recently turned down her offer and is preparing to head to trial shortly. It is not uncommon for them to make offers right before going to trial, so who knows if you would end up actually going to trial.
There is so much to consider and it is hard to know the right path. If you and your attorney feel you have a strong case, hold your ground for a reasonable offer. In the end, all you can really do is follow your heart and do what you feel is best for your child.

We are into our suit for a year now, other side has called for our depos this month, is this too soon to happen or is this how it starts and then drags for years.
