More on Medical records and Medicaid

This is what I have found out today. I got in touch with a lady at Alabama medicaid she said" we will release records only to doctors and lawyers. So I called the lawyer back and gave them her number so they could request our records. This is what I was told by the law firm. The reason we are getting the run around and having to go through medicaid to get records is if we settle or win any amount of money medicaid put a lean on it for their part. So What does that leave my son??? Do other insuracne company's get their share too???? More question.
The more I find out the madder I get. I still don't understand how they can keep your records when its your own stuff???

In any settlement or award you receive all "third party payee's" such as insurance companies,and any unpaid medical bills must be paid first. I'm sure Medicaid is considered a 3rd party payee. In our settlement with one doctor Michaela "got" $250,000.00. After the attorneys fees, insurance companies and all bills were paid she only had $104,000.00 put into a guardianship account. So now we must be prudent and invest wisely.

Michaela received Part C benefits till the age of three. I thought for sure they would want reimbursed but I was told they don't ask for reimbursment. The insurance companies settled for only 40% reimbursment. That's because our attorney has a good negotiator in his office. After all is said and done it can be discouraging but it's better than nothing.

Sounds to me like you need to have a heart to heart with your attorney and have him explain afew things to you. When you think of questions write them down. Don't be afraid to call him. The thing that has worked best for me is having my attorneys e-mail address. I just e-mail my question and he can answer at his convenience, we don't get side tracked in other conversation and I don't get billed extra for the time. Yes, that is true that the medicaid and the insurance companies will get a portion of your settlement. Depending upon what state you live in, EIP will or will not be paid back. You need to take this into consideration when settling. Usually, your lawyer will try to negotiate the insurance and medicaid down.
