LAWSUIT LOST TODAY

we are sad to say that our daughter's lawsuit went to trial for 8 days and today the doctor that caused this terrible injury to our child was not found negligent. the doctor knew she was negligent because she was not present for the verdict. little did she imagine that the jury found her not guilty. in our case the jury was misled by the defense attorney using "out of content quotes."

has anybody lost their trial? if so, did you appeal? and if you did appeal was the verdict reversed? how long does it take for an appeal?

our opinion after today is that if you are offered a settlement even though it may be low you should think seriously about taking it. we wanted our doctor to be accountable and responsible for what she did to our daughter.

Our daughter did not receive justice today.

I am so sorry for you and your child. I am just starting and I can't even manage to get my hand on my medical record were I had Thomas. These kids did not ask for this and they will need help for the rest of there lives. Don't give up. Chin up keep on trying for your baby!!!!

I don't know anything about the law but I have faith in a God that will punish those who hurt little children. It can help me to feel focused(consoled) if I know God is going to make everything alright later....It sure hurts now though. I'm very sorry for your loss...Makes me wonder how those people can sleep at night.

My condolences! does your attorney think your case is strong enough for an appeal? Has he ever handled a BPI case before? We settled with the delivering doctor because he offered his policy limits and had no choice but we are awaiting trial with my usual OB (SOB) who induced and left the hospital knowing I needed a c-section but didn't want to do it.

I'm so sorry to hear of your bad news. Your family must have put a lot into this lawsuit and you must be feeling incredibly let down.

I am really sadden by this for you and your family.
I just can not understand how the jury can take some
mis-quotes over your babies injury. Babies are not born in this type of condition, and it is just not normal or natural. What is wrong with those people are they so desensitized that they can not feel your your baby pain? I guess this really hit close to home with me, because i am an adult and i have a bilateral Brachial injury so i can really relate to you and your child. I am so sorry our world is the way it is.

This is a good example of why BPI needs to be more known. The def atty probably downplayed the injury and the jury bought it. I feel for you and your family. Good luck with your appeal.
