Unfortunately, the attorneys will now be rich, if there is subrogation, the insurance companies will get paid back all they spent on this child, and the trust attorneys and investment managers will all be able to support their real estate and fantasy car dreams... the child and family will get NOTHING compared to what they SHOULD get. The whole thing is disgusting, not just the hospital's statements. For those of you who already went through this, you know what I'm talking about.

I applaud this case, and am very happy that this family will be able to afford the care for their child. We recently settled our lawsuit and are extremely pleased with the settlement amount. Did my lawyer make money from my lawsuit? Yes, he did. He also did the work of a lawyer. And, he worked very hard. And in a time of decreasing verdicts, he did an incredible job for our daughter.
We also went through subrogration. If your lawyer allows the insurance company to get dollar for dollar in subrogation, he/she needs a lesson in negotiation. I think subrogation is awful and we held up our settlement agreement fighting with our health insurer because we wanted them to admit that our monthly premiums were designed to pay for the things that they paid for (surgery, therapies...) but they don't see it that way. You can tell them to take a hike, but then they say they won't pay for anymore medical care because you have a settlement for that. Hmmmm, interesting. Now there are laws that need to be changed.

I would give every penny back to have a kid without an injury, but I do not begrudge my lawyer his fee. He did his job and he deserves to get paid for it.

I am also in the process of suing the doctor for my daughter's injuries. I think the settlement that the family above recieved was fair and for a legitimate reason. No child should have to suffer from the negligence imposed by a doctor, someone who we trust to do their job to the best of their ability. The doctor that delivered my daughter was not my regular OB/GYN-just the doctor on call that night. She had even sent me home 3 hours earlier, telling me I wasn't in labor!!! She appeared cranky and frustrated and I guess when she saw me back at the hospital later, in FULL LABOR, she just wanted to hurry and get my out of her hair.Or at least that's the way I felt! My daughter, weighing 9lbs. 14 oz, became impacted behing my pelvic bone. Granted, the doctor told me if any problem arise they would do a C-Section. Shouldn't my baby getting stuck set of a red light!!! Now, my daughter has to go throw life with limited, and I do mean limited, use of her left arm. The doctor and hospital should pay!!!

I am soo happy that the parents were able to get something back for their heartache!!!! It gives some of us hope that justice will preveal. It is sad to me when the hospitals and legal systems can put a price on your child's life and well-being. We all here know that the injury is a result of total negligence of the doctors. When are they finally going stand up and take responsibility for their actions. This case is proof that the hospitals & doctors will get it in the end.

I missed this story but I was interested, since I had a bpi delivery at this hospital too.

Same hospital? Sure would be nice if a few of you could get together or someone could drop off some information to a few important people there.

Do any hospitals have a shoulder dystocia emergency protocol? It sure seems like all of them should have to just like they do with some of the other medical emergencies that occur.
