I wouldn't give up quite yet. I know of attorney's who do not just stop with one expert that doesn't think you have a case. I think we all have cases (for the most part) but proving it can be another story. I really do know of a few lawyers who will find an expert who supports your case. If they believed in your case enough to take it perhaps they could try getting one or two more expert opinions. You may also want to find another attorney. Good luck.

If you dont want to wate DONT!file the CHARGES! I understand how you fell I was born with ERBS over 50years ago and had legal issues defending my rights over the years.YOU have put to much in to your child and trying to protect your childs right!! If later you need to settle do. but do it with the evedance and cost incurred and a amount for future surgrey! JUST when you had to deal with ERBS and now laws it gets way to much!! REMEMBER THIS ALL YOU CAN DO IS WHAT YOU CAN thats it. this I have done all my life.This is my oppion I am not a lawyer just some who has gone threw legal issuse because Of my ERBS I EVEN HAD TO PROVE ERBS IS A DISIBITY and I did.Who ever knows the outcome in life is unless you try.Tom

Don't give up. We were dumped by attorney after attorney till we found one that would take a chance on our precious baby boy and after 4 1/2 years we settled out of court....not a huge settlement, but enough to help my son through the years and into college. OUR ATTORNEY WAS EXCELLENT>>>>>we love her so much.....she is also representing someone else on this board....who was told didn't have a case. Fortunately, she doesn't do it for the money, she does it for the kids and that was in our favor......

To everyone else, thanks for your replies. I need to put in another call to the lawyer to find out more info. He wants to wait another 6 months before deciding but then I think it will be hard to find another attorney before her 2nd bday.
