- Injury Description, Date, extent, surgical intervention etc: My oldest daughter suffered a LOBPI. We were sent home form the hospital without being told anything was wrong. She had nerve graft surgery at one year of age, tendon transfer and release at 3 1/2 yrs of age.

You said Ella needed a brace/splint because of a contracture. I would bring up that the contracture is not going to go away on its own. As she grows adjustments will need to be made or new splints will need to be made. Also as mentioned before is the concern of muscle atrophy. Dressing and personal hygine skills need to be addressed still with OT. Some task she is not ready for at 13 mo, but will become a big issue before she turns three. The other item that I brought up in our case review recently is that Rosalynn goes through improvement spurts. She will make signifigant games in a relatively short time then platue. We built in some flexiblity to our therapy schedule to address these times of gain. We agreed to do one time a week right now because of scheduling conflicts with the OT, but as needed we can increase it to twice a week.

i think the one thing that i pointed out in the disability hearing was a paper that i believe dr nath published regarding due to the fact that growth plays a part in the nature of the injury you really can't predict the outcome until about age 5 and at various stages things will appear better than they are but problems will likely reoccur. i am not saying this very well but the information is from tch maybe you can find it on the web site.
in marlin's judgement they did make mention of that paper and as a result they will not reasses her until she is 5

WOW!!! Thank you all so much! Your posts are wonderful. I can't be happier with the responses. Francine, thank you for emailing the article...its wonderful.
Heres the update:
Our PT was here today and we did some little things of what Ella can and cannot do. She was able to do most of them, but as most of you mentioned...she couldnt do it with her left (injured) arm for most of them. And of course, I think they just marked it as yes b/c she was able to do it with her uninjured arm. I told Ella's PT today that I know many moms who have their children with Erb's Palsy still in birth to three regardless of how severe the injury is. I told her that if I have to have Dr Waters write something out I will b/c we see him Nov 18th. I said I know she still needs therapy and that is what I expect to get for her. It hasnt come to the point of appealing yet, but if it does I thank all of your for your info. It is so helpful even now. So the PT said before she left that she will talk to her boss about keeping Ella in services and she also said that one of the not so good things that ella does at this age is a "raking grasp."
She said that a "raking grasp" is for the 7-8 month range. Although she can pick up with her left hand, she can only do it with that type of grasp. Not sure if that will help in her scores. So I know I am changing subjects b/c I am writing as things pop into my head, while Ella is sleeping on me right now (I am trying to type with one hand =) )...the rest of her "test" is in the next couple of weeks with her OT. I guess I will see what happens and I will update you guys. Thanks so much, I am always learning something new here!
