Not sure how Dr. Kozin is in the operating room, only the court room. He testified for the defense, against us! I still don't understand how someone can work at Shriners and attend UBPN events, then show up in court on behalf of the OB.

I love Dr. Waters and his entourage.

Be honest, Corinne. Your child was seen by Nath, had multiple surgeries with Nath, you are (or certainly were) an ardent Nath proponent and he testified at your child's trial. Has his prestige fallen so far that now his supporters need to hide their affiliation with him in order to attack other doctors? How sad.

Truth be told, the accusations your lawyers made against Kozin and his alleged financial motivations for testifying as an expert at your child's trial probably sunk your trial as much as anything else. They opened the door for cross examination into Nath's own unconscionably high fees for testifying for plaintiffs against OBs and his tendency to claim expertise in areas where he has no training. Your lawyers were idiots for doing that. You should be mad at them, not at Kozin for telling the truth.

If anyone wants to hear for themselves Kozin's testimony in the trial Corinne is referring to, feel free to contact me. I had to hear it for myself after this came up so many years ago. Suffice it to say, I am still a strong supporter of Dr. Kozin and all the good work he does.

The point of my previous post is that I don't understand how someone can work at a place that provides free care and then turn around and testify for the defense. It is the affiliation with Shiners that I have a problem with.

Why the snide comment for me to be honest? I do love (present tense) Dr. Waters.

Unless you have the transcripts from our trial, I'd appreciate it if you would not comment and risk reporting inaccurately. Thanks.

Corinne,

I have the audio recording of Kozin's testimony at the trial from which the transcripts would be made. I have listened to all Kozin's testimony. The transcripts were not available without paying $3 per page back then, and it was 80+ pages. The written transcripts are probably available now for anyone who wants them. I got the audio because it was being widely spread on this board that Kozin testified for the defense at a trial. In reality, he was called as an expert witness to provide expert opinion on the care plan formulated for your daughter. He did not testify about whether or not the OB had caused the injury or not. He even got the defense lawyers all upset when he described how the injury happens ("the nerve is pulled apart like taffy").

My opinion is this: our court system is innocent until proven guilty, and if people pre-decide who is guilty and who is innocent by testifying or not, then that undermines the entire system. And exactly how is charging $5000 for an hours worth of work (Nath) doing any BPI child any favors? That money comes out of any settlement the child gets. So Nath makes thousands of dollars a minute for surgery PLUS an outrageous sum for testifying, too? A big reason why Nath made over six figures every year during and right after his affiliation with TCH was his eagerness to testify for kids... for a huge fee.

I would urge anyone who has concerns upon hearing about this case to actually read and/or listen to Kozin's actual testimony before passing judgement. Don't just take my word for it.
