Mary, to answer your questions -- yes, our daughter's injury was due to excessive traction used to relieve a shoulder dystocia; we filed just before she turned 2 y.o. and went to trial 3 years later. We spent 2 weeks in trial (we weren't offered a settlement) while I was 7 mos. preg. and lost. Hopefully, things will workout better for you. Thanks for all your replies! To michael's mother: I filed the lawsuit when my son was around one. I also had to switch lawyers because the first lawyer would not take the case because my son had no surgical intervention. My son was diagnosed with shoulder dystocia at birth and then about ten days later their OT doctor said he had brachial palsy aka "Erb's Palsy"
To Brandonsmom: My husband is an active duty member of the military. Is your family still active? I'm having lots of problems with the "Tricare" and getting approvals for my son. I'm wondering if you have the same problems?

No we are not still miltary....thankfully. They discontinued my son's insurance when he was two trying to get us out of the miltary. IT WORKED. I had nothing but PROBLEMS with TRICARE. They just didn't want to fix the miltary's mistake !!! They ended up fixing the mistake and paying for it years later. Are you trying to sue...be careful, they will try and get your hubby out at all cost if you do. I know more than one family that had this problem. Was your son born in a miltary facility.....??? Gayle

We settled outside of court for my daughter. Our attorney explained to us that if we look for money for ourselves it is only going to come out of the money that we get for our daughter. We decided to just get the most we could get for her!!! I felt in the long run she is going to need it!! We did get the money we layed out for braces and casting etc, etc..... I just feel that when my daughter is older she will need it more than me.

I see posts like this about lawsuits towards the doctors that delivered people's kids on this board. My parents never sued the doctor that delivered me(I am 26 ROBPI) and I am not regretful their decision. I'm not saying that doctors should not be held accountable to mistakes. I just wanted to add that I don't care that they never sued just in case any mom or dad on this site is worried that their kid might be upset in the future if they don't sue.

Brandonsmom: My son was not born in the military. At the time we were not married and i carried him on my insurance when i worked. The military is making me go through hoops just to go through the appeals process for a surgery. They actually wanted me to travel all the way to Maryland to see some doctor and I got pretty upset and did some searching and found a doctor that actually was in the next state over (an hour and a half away) and had him seen there for their third opinion.

MIKEYSMOM Well then your husbands career should be safe. You are lucky you did not have him in a military facility they make your life horrible then. Anyway, there are no BPI military specialists, then finally paid for Brandon's surgeries with Dr. Nath after the threat of call the local newspapers.....Good Luck, there is a military liason here, but I cannot remember her name...JULIE maybe someone else can help !!!
