Hospital not wanting to release medical records of birth

I went to get the records from when I was in the hospital and to get Thomas's records from his birth and they would not release them to me they said it was because I was on medicaid. I have been to alabama medicaid site and can not find out any thing. I have been able to get other records of mine and Thomas from other hospitals and doctors offices why will this hospital not release mine. Just wondering if any one else has had this problem. thanks carron

They are stalling you! You have the legal right to have your medical records and if they won't give them to you your attorney can get them for you. This isn't all of the tricks they can play either. In our case they didn't want to admit they knew Michaela's heart had stopped beating and they switched the records from her scalp fetal monitor but our attorney was on the ball and found they didn't match. It's called covering your butt. Or maybe they don't have any records. Legally if it's not in the record it didn't happen, so sometimes they don't make the records or keep very minimal ones. The lawyer had tried to get them and got the run around and thought it would be easier if I went and got them but they must have a red flag hanging on mine. I am going to talk to my medicaid worker tomorrow and see what she can do I also left a message for the lawyer. Thomas had stopped breathing before they got him out.

Carron, I don't understand why it would be easier for you to get them instead of your attorney. That raises a flag right there. He can supeona the records if need be. Michaela's heart had stopped and it took them 20 minutes to resuscitate her but according to the records her apgars were 2 across the board. tell me how that works when there is no heartbeat and the organs are shutting down? Anyway,keep on top of your attorney and the hospital. LeeAnne

In Kansas, there is a jury instruction that if records are inadequate or missing, they must assume that it would help US, not the DR. We found that out from our attorney. We too, did not exist at our hospital. No progress notes from the dr. or nurses. Interesting isn't it?

I was able to get my daughters records initially, but when I went back to ask for her PT records they said they were lost. Her PT is no longer witht he hospital & they still refuse to come up with them. Good luck, I know how fustrating this is. It almost makes you wonder if they are trying to hide something.

Carron,
The same thing happened to me BUT with the OB/GYN office.
They couldnt FIND my records!!!!
I told them if they DIDN'T have my records ready for me to pick up by 4:00 pm that day I WOULD be IN with a police officer.
GUESS what my records were found VERY fast :-)
The excuse I was given was they were in on the doctors desk.
My records have changed areas on them - from scratched off areas where the protein in my urine number can't be read, TO changed numbers on my fundus measurements.
Just think we put our life in these peoples hands!!!!!
