Trial
We are going to trial and I was wondering if anyone has any advice for us. My husband and I will both be testifying. The defense is using the theory that this could of happened in utero. They are also saying that he looks really good right now so the jury shouldn't be too concerned about how bad he looked at birth? I can't believe they actually can do this. Anyway, thanks.

Also from personal experience...like Peggy said, keep your composure. Know matter how upsetting it gets, stay calm. The defense lawyers will lie, try to twist your words around and try to make you out to be bad parents. Keep cool and stand your ground. Keep your answers short and direct (yes or no) do not go into any detail unless asked. Look at the jury when you speak. It does not matter what your sons status is right now. The fact is he was injured and it shouldn't have happened. My son had great function at our trial, but that was after countless doctor visits, weekly PT and OT visits, e-stim, pool therapy, ect. It had nothing to do with how bad the doctor injured him to begin with. That is a mute point. The only fact that matters is YOUR CHILD WAS INJURED....PERIOD! Sorry, this is a touchy subject. Just try to stay calm (I know it is hard), vent all your frustrations out after you are out of the court room. Good luck and best wishes. Keep us updated. When is your trial?
