I am in desperate need of help. Hopefully someone out there has an idea. Here is my story: My child was born with a severe OBPI. My only complication was High Blood Pressure. The OB was not my doc, but the one on call that night. The delivery was quite easy. The baby was fine and the only complication during birth was the cord wrapped around her neck, which was released with ease. We are involved in a lawsuit now. The lawyer is going to have to drop our case unless a miracle happens soon. Ya see, the lovely OB didn't write anything at all about complication during birth other than the cord. He covered his bottom and failed to record properly. I , my family, lawyer and engineer and OB all know that she was a SD birth. but there is no proof. To me the proof is the trauma to her arm, her birth trauma (bruised and swollen face) and the fact that doc did all the work/pulling. We have an engineer (Robert Allen) to testify on our behalf , but no OB. I am spending every waking moment trying to make since of this. or find some loophole to win this. If anyone has any ideas or a similar situation, I would love to know. Thank you so much.

We were dropped by two law firms for the same reason. The OB did not document what happened during the birth. I can relate. I wish you the best. I wish I had an answer for you.

We had the same thing doctor covered his butt. Two lawyer have drop us to and my child still can't use his arm and has had two surgeries and more to come.

I'm really sorry you are going through this. Even though I am in a legal situation myself - I can tell you that I don't understand the logic in any of it. I wish you the best of luck in trying to get this worked out and to find someone who will support your case.

Has your lawyer compared the OB records to the nurses records. I'm under the impression that there should be 2 separate accounts: one the OB's and one the nurses. Perhaps they won't jive...Good Luck! My prayers are with you and your child.

I too have had an issue with attorneys and yes there should be the nurses' diaries of what happened...If the attorney has not compared these with the ob notes then he/she needs to.
I know how frustrating it is..we have proof with our children's injured arms but nothing written down by the doctors..it just stinks...
