Still desperate after all these months...legal advice, please.

For any legal experts out there...
We lost our lawsuit last May after 3 years of fighting in a case that was totally clear cut negligence, and we filed our lawsuit for our daughter but we were her "friends". So the lawsuit wasn't just in her name.
My question is, can she not sue on her own in her lifetime with out our names listed. IS THERE NOT ANYTHING WE CAN DO???? EVER????
Sorry I haven't been around lately. I think about you all often and appreciate the personal e-mails I have recieved. Just since losing our lawsuit, I have been so miserable and just sad, just sad.... I never thought I would make myself so burnt out on this injury. That sounds horrible of me. Has anyone else experienced stress in their marriage over this? I count my blessings every day. I just can't get over the sadness. Logan is so amazing, she is a beautiful child. She is now taking gymnastics 2 times a week and does everything the other kids do, sometimes even better!!! She even does a back bend and pushes herself up off the floor with her arm! And to think we never thought she could... We are really lucky with how well she has done post mod quad and Nath says wonderful things about her arm and no future surgeries. Sorry so negative. Just wanted to say HI and hope you all had a fun Halloween and to let you all know I was still here every now and then and thanks to those of you checking up on me. I will be back, kind of needing a new year to regain some composure and get my "poo-poo" together.

I am sorry to hear that you lost your case. I regret there is nothing else that you can do. Your daughter, or anyone else on her behalf, cannot refile the case at a later time. The case is closed. Hey, girlfriend! I've really missed you! Me and Leelers have been wondering where you've been hiding! I'm so sorry you lost your law suit. Leelers lost hers, too. I can't give any legal advice, but wanted to say hi and to say I've really missed you a ton and been thinking of you often.

Sorry to hear you lost your lawsuit. Your question regarding strains on the marriage and being burned out hit a nerve. My husband and I were trying to be strong for each other, so we didn't talk about our "real" anger, sadness, etc. It wasn't long before we were two miserable people and our marriage suffered. Neither one of us could figure out what the problem was until we had an all out cards on the table talk. We found out that we were both hurting so much because of our daughter's injury and were carrying around this tremendous stress of wanting to make her better, wishing we had done things differently, etc. Anyway, I'm rambling ... in the end, our marriage survived. Bree is 7 now, facing new challenges and we are still stressed! We did win our lawsuit and believe it or not, the only satisfaction that brought was that I don't worry about her financial future. Otherwise, it doesn't make a difference because it can't make her arm better. Rambling again, sorry, hope you feel better. God needs special people to take care of his broken angels .. you are special, he gave Logan to you.

I have been so worried about you. I wish that you would have let me know about the case, I feel very crummy about not being able to offer you my feelings and condolences about Logan's case.
I know how lousy you feel.... we never made it to court though...the lawyer that we used tried for 2 years to get a person other than himself (he isn't medical mal lawyer)to pursue our case. At first, they said we had an open and shut case and were all over it.....until one day when the dr. that we had used (neurologist) went to work at the hospital where my daughter was born.... and the diagnosis changed from grim to 95% recovered. Don't get me wrong if she is indeed that well....I am so blessed!!!!! And she is much better now, but when the doc jumped ships, I lost my faith in her and the case was suddenly not enough injury to pursue. We were up, then down, then up, then down, and on and on.....
I am so sorry that you guys lost. It is such a shame that we can be treated that way.
