We are filing under our daughters name. We originally wanted to file under our names (the parents) but the lawyer who had our case did not file and had the case for almost 2 yrs and the statue of limitation ran out for us. I do not know the differents, this has not really been explained to us. Sorry that I could not help.

Gayle and Sonia add my child's name to the list of children who fit this description- no surgery at 2.3 has some supination needs therapy 2-3x a week, will need therapy for a long time and has good function and range. We too were rejected as he said we did not have a strong case. I am in the process of researching lawyers but I think if we file we will work hard to settle even if it is not a huge amount. Our lawyer did explain that to file under the statue of limitations for the state that is only under the parents name the benefits to this is you get moneys for your hardship and expenses otherwise you file under the child's name in most states until age 18 and get money for the affect on their life so you are not by any means out of time. Maybe we could chat wed night about this subject on Fran's chat and see if we could come up with some ideas. Godd luck to all in this situation.

My attorney would not sign with us until my son had surgery.....I cannot tell you why....I think they feel that they have a better chance of winning if surgery is involved...Could be the case./...but still not fair
