hello

I hope this finds you all well,

my question is has anyone gone for malpractice due to injury. for those of you who don't know Mine occurred due to dr. and positioning of my arm.

I think I was kinda wondering, I started the process in my state (NY) you only have so many weeks or months to file i guess. so it has been filed. but now I kinda feel like the lawyer is just leaving me hanging. He is doing this case on if I win he takes a cut. So maybe he just will inform me of the next step. Anyone familiar with process at all? any help would be great.

Injury Description, Date, extent, surgical intervention etc: LOBPI, LTBPI at age 6.5, Sensory Issues, CP, Diaphragm Weakness, Aspberger's

I think it would be best if you asked your attorney how the process works and what his timeline goals are. I know that some cases get resolved fast and some cases are still hanging around for years. Your attorney would know best for your case.

I would ask your attorney what is going on. If he/she doesn't reply to you, or dodges your calls, then consider it a RED FLAG! I sent all of my medical records for my son to an attorney,(twice, as he lost the first set!) and he was all gung-ho to help me out, then, he didn't return my calls, and low and behold, the statute of limitations had passed (as far as filing a lawsuit for being parents of an injured child) but, he can still file something before he turns 18. Just be careful as to who you use as an attorney. This specific attorney sought ME out. That should have been my RED FLAG. Please feel free to email me with any additional questions.
