malpractice/Law question

hello

I hope this finds you all well,

my question is has anyone gone for malpractice due to injury. for those of you who don't know Mine occurred due to dr. and positioning of my arm.

I think I was kinda wondering, I started the process in my state (NY) you only have so many weeks or months to file i guess. so it has been filed. but now I kinda feel like the lawyer is just leaving me hanging. He is doing this case on if I win he takes a cut. So maybe he just will inform me of the next step. Anyone familiar with process at all? any help would be great.

My son had an accident and lost the use of his left arm, After 4 yrs he still has excruciating pain 24/7 and spikes whenever. We have a Road accident Fund we can claim from, but it has taken 4 yrs to get to the final stages. We changed lawyers after about a year( too long!) Find out about lawyers specializing in that kind of claims and research their track records , also nr of cases they do in a year , and then decide.For us, we gave the 1st guy 2 much leeway because he was near and available. BIG mistake By the time we changed to some-one else ,valuable info and time were lost. Blessings

I think most cases like this are on a percentage to the lawyer if you win. However I think you should be informed throughout the process. If your lawyer doesn't seem interested, I think I would look for another. We haven't persued anything legally in Dustin's case but this would be my feeling. There is a lawyer, from NY I think, Ken Levine that answeres on the boards sometimes so maybe he could help you out. He has some posts on the "general boards" right now.

Hi,
I know all states are different and malpractice and injury also carry different statutes of limitations. CT has 2 years from date of accident. You can probably look it up online to be sure. That's the beauty of the internet, you can find out just about anything. Just start googling, NY Statute of limitations medical malpractice and see what comes up. My advice to you if you feel your lawyer is leaving you hanging, call him and ask him. Also, ask him to copy you on all correspondance, etc. Good luck, i hope he gets you what you deserve, and then some!!!! Although there is no amount of money that can really replace what so many of us have lost.
