We won in Trial!!!

Post by Samsmom »

It's been a little bit since I've gotten on the board and posted anything. I just wanted to let everyone know that my husband and I have spent the last two weeks in trial on behalf of our son and his brachial plexus injury. We just got the verdict from the jury today and the doctor was found guilty. We won!!!! It has been a long road but so worth it for our little boy. Our son is 3 1/2 years old. My son has an injury to C5, C6, and C7. He has had two surgeries. We live in Arizona and medical mal practice cases that go to trial almost always side for the doctor here. We are so happy that the jury was able to see the truth and that justice has been served. Our attorney Sam Cullen was so wonderful to work with. He always kept us informed and presented our case very well in trial. More then anything we hope the doctor has learned something from this and that another child will not have suffer like our child has.

Injury Description, Date, extent, surgical intervention etc: LOBPI. I am 77 yrs old and never had a name for my injuries until 2004 when I found UBPN at age 66.

My injuries are: LOBPI on upper body and Cerebrael Palsy on the lower left extremities. The only intervention I've had is a tendon transplant from my left leg to my left foot to enable flexing t age 24 in 1962. Before that, my foot would freeze without notice on the side when wearing heels AND I always did wear them at work "to fit in" I also stuttered until around age 18-19...just outgrew it...no therapy for it. Also suffered from very very low self esteem; severe Depression and Anxiety attacks started at menopause. I stuffed emotions and over-compensated in every thing I did to "fit in" and be "invisible". My injuries were Never addressed or talked about until age 66. I am a late bloomer!!!!!

I welcome any and all questions about "My Journey".

Thank you for your kind comments. After the trial we were able to talk to the doctor and share comments. We are forgiving and going through this trial has made him change his ways.

Injury Description, Date, extent, surgical intervention etc: I am ROBPI, global injury, Horner's Syndrome. No surgery but PT started at 2 weeks old under the direction of New York Hospital. I wore a brace 24/7 for the first 11 months of my life. I've never let my injury be used as an excuse not to do something. I've approach all things, in life, as a challenge. I approach anything new wondering if I can do it. I tried so many things I might never have tried, if I were not obpi. Being OBPI has made me strong, creative, more determined and persistent. I believe that being obpi has given me a very strong sense of humor and compassion for others.

Dear Sams Mom & Dad

It is so good to hear that the you were able to forgive the doctor and he will make some changes.

I am glad that you won but even happier that you were able to make him realize he had to make some changes in the way he practices medicine.

Thanks for sharing
