Everybody is free to do what ever they want but I when was on the board, there were somany questions about the lawsuit. Personnaly I do not believe in it.
I can not understand why people want to go through al the trouble and pain again just for the case of it? I can not understand that people can get statisfaction of it. Is it about the money then?? If so, there aren't enough billions in the world to get back everything my child has lost because of the BPI. Nothing can. To compensate your pain, lost, your anger? I trying to understand. For me there is nothing that can remake my dreams, there is not much that can take away the pain. My kid remakes my dreams when he oved his arm after one year. He makes me happy with his smiles, tender love and care, he makes my pain go away when he tells me what he have learned with his arm. He makes me smile when I see him grow up like a normal child who happend to have a disabilty but with he can live a very normal live. I can relate to the pain, suffer, discourage, the anger, the sorrow and everything we feel. I been there, seen it. But I moved on and started to live. I realise that going to all that again doesn't give me the satsifaction. I Realise there is so much more in life than the BPI. Look at your child and you will see.
Perhaps I'm a simpel mind and overhere we don't have
to pay the bills for hospitals and operations our selfs that makes the difference?
I'm sorry to think this way. To those who are going through a lawsuit.Please understand I'm not against you and it you good right to do so. I'm just trying to discover/finding out why people want to do so.

Well in the US, insurance companies have limits and the limits are very small. So for many people, they sue to make sure that if their child needs more surgical procedures, or equipment (like e-stim), or more therapy, or pain management - that they will have the money to be able to get this if their insurance will no longer pay.

It is not just about the money!!! We also want the OB to realize that what she did was wrong. When a baby gets stuck you just don't pull hard to get the baby out. There are proper manuevers that should be used instead. We want the OB's large practice to pay more attention to each woman and be on the lookout for warning signs. Since our OB has a "god complex" we know of no other way to get her attention and hopefully make her change her ways. She left the delivery room so quickly after she delivered our daughter and never spoke to us again. She lied in the records to cover her a**. One way or the other she needs to face what she has done and learn from it.

This was a preventable birth injury for the great majority of us. Because of it, we have huge medical expenses above what the average insurance company pays. This last year alone we had $9,000 out of pocket medical expenses. My career is down the tubes because I have to run my child to ot, pt, water therapy, speech therapy, surgery out of state, rehab, etc. U.S. doctors have medical malpractice to cover these cases of medical negligence. Thank goodness we have the prerogative to sue. The doctor didn't lose his house, his Lexus, his vacation in Europe, his kids' private school...he didn't miss a beat. And maybe, just maybe, these lawsuits will make the medical profession start to train their doctors on correct maneuvers for shoulder dystocia and prevent further injuries. Their arrogance is shameful.

I have not sued and wish I had the courage to do it....We still may in the future but I'm not sure but
I understand exactly why people sue...This inury gets worse in some ways every year...What kind of job will my son do? How will he support a wife and children? People do discriminate against people who have differences and there's not much that can really be done about it if you can't prove it. He has to have therapy for the rest of his life and who knows how many more surgeries are lurking around the corner....He has a pre-existing condition!!! No insurance company is going to accept him...Right now he goes to the government clinic because he is a kid...What happens when he turns 18???
Does he get substandard care right now...probably... because there isn't a BPI specialist around here. He has been through so much that I wish he didn't have to go through but dang you're right it is about money sometimes....Money to pay for college, money to get a car and make the necessary...adaptations so he can drive it safely...Money to help pay the bills because he doesn't get to have the job of doing what he might have done before...there's a good chance he will never be in the military, be a policeman, fireman, I could list a million things he can't do but I can also list things he can do as long as he has adaptive equipment or someone to help him...Have you ever lifted a case of typing paper??? Such a simple job that most people do every week in their jobs but can my son do it? NO. That ability was ripped away from him when his brachial plexus was ripped apart by a damn woman who was in a hurry to get the hell out of her situation. She panicked and so now my son has to live like this....She deserves to pay....maybe it will cause her to get more training and learn to do her job before she injures another infant.
Sorry if I sound angry...I am!!! My son's life was forever changed by a thoughtless act and He may never be able to recover his arm but he shouldn't have to spend his life living under a bridge because someone else screwed up!

Preexisting Condition.....NOT.....if your child is under the age of five.....most and I mean most insurance companies will not consider it a preexisting condition. We were in the MILITARY and that is what they told us when we decided to get out......but I have returned to work and my company has Blue Cross Blue Shield and they cover all my son's bills including TCH visits.......his last visit to TCH cost me $25.00 !!!!! - Injury Description, Date, extent, surgical intervention etc: My oldest daughter suffered a LOBPI. We were sent home form the hospital without being told anything was wrong. She had nerve graft surgery at one year of age, tendon transfer and release at 3 1/2 yrs of age.

Ok I don't mean to be harsh, but what does it matter to you? Those of use involved in legal actions know the pain that is involved. And you are correct it is our right. You can see from the post above how strongly we feel about it. We are doing it to get justice our children and to try to prevent this from happening to anyone else. I hope these reason can make it obvious to you why people take legal action and that it is not for greed.

Honestly, the lawsuit I filed on my daughter's behalf is because I want to make the doctor pay. I don't care if it's a dollar he has to pay so long as everytime he writes that check he remembers what he did.
He was so nasty while I was giving birth. He even threatened to leave the room when I told him to stop that he was hurting me!! So, no I don't feel bad or think it's wrong to sue

What do mean Why so many lawsuits?? I'm sorry but are you CRAZY??......Do you know what these idiots have done to our children? These a**holes have taken away so much from our precious little ones. Because of their mistakes some of our kids can't feed themselves a cookie,comb their hair,play baseball,swim,tie their shoelaces...and many other things that we non BPI people take for granted.
Do you think those "medical professionals" even think about our children or even care what we are going through?....NO .....they do not!
No money in the world is enough to bring back what these jerks have taken away from innocent babies. They did this to us and our families and they still got paid for "doing their job". We all thought we were in good hands. I am fortunate that I do not have to pay for surgeries and stuff but what about all the people that do? What about all the time we take to go to doctors appointments and therapy?...someone has to pay for that!! While our kids are going through surgeries and are going through therapy these a**es are probably eating a big fat steak,drinking wine,having a party!!!And you know what?...we have not even crossed their minds.
