What to do next?

I really don't know what to do, my lawyer said he had some affiliates look over my case and they can't find any mal. prat. involving the delivering Dr. My lawyer said he thinks since they knew she was going to be over 10 pounds and I asked for a c section they should have done one and the fact that the Dr showed up an hour after she was crowning there should be something we can do.

After hearing it the first time I am really disappointed. I think the Dr should be held responsible for Abbie's injuries.

Anyone else ever have the same problem? What did you do?

Hi Amy,
I can't say that we had the same experience, but we have been through the process of a malpractice case. It's not an easy road to travel and the outcome is by no means certain, but something you feel necessary to do - regardless. I can relate to that feeling.
You may want to contact Ken Levine, he is an attorney that has posted on the boards before and helped others with questions (including me) and handles many BPI cases. He may be listed in the Resources portion of this website. I think his office is in Mass., but I believe he tries cases in other states as well. He should be able to give you an honest assessment of your case and it's merits. He's very experienced in handling BPI cases. Have you talked to any other attorneys about your case? What state do you live in?

I MUST SAY THAT MY HEART GOES OUT TO ANYONE WHO IS WILLING TO STAND UP AND FIGHT ON OBPI!!!!!!!MAL.PRAC IS ONE OF THE HARDEST CASES TO PROVE. I HAVE BEEN FIGHTING FOR SIX LONG YEARS NOW. BEEN TO TRIAL, JURY FOUND NOT GUILTY,JUDGE MADE A FEW MISTAKES,WE ARE IN THE APPEAL PROCESS NOW. I EVEN HAD A VIDEO THAT SHOWED IT ALL,AMY YOU WOULD NOT BELEIVE THE PROF WE HAVE ON THIS CASE.I LIVE IN A SMALL TOWN AND THE DOCTOR IS A BIG TIME DOCTOR HERE.THERE AGAIN WHO KNOWS WHO.IF YOUR ABLE TO HANDLE THE STRESS AND LOTS OF IT THEN MY ADVICE TO YOU IS TAKE IT TO THE TOP.WE'VE GOT TO STOP THESE DOCTORS SOMEHOW.KEEP CALLING LAWYERS,IT TOOK ME ABOUT 4 LAWYERS TO GET ONE THAT WAS REALLY SURE.
